Terms of Service

These terms govern your use of Publisher, a service operated by Heliom Labs LLC, a company incorporated in New Mexico, United States (8206 Louisiana Blvd NE, Ste A #7492, Albuquerque, NM 87113, USA). By creating an account you accept them.

1. The service

Publisher lets you upload a video once and publish it to your own accounts on Instagram, TikTok, YouTube, Facebook and Snapchat. Publisher acts as a technical intermediary: it transmits, at your request and after your explicit confirmation, the content you provide to the platforms you select.

3. Connected accounts

You may only connect social accounts that you own or are formally authorised to manage. You grant us permission to publish on those accounts strictly for the publications you confirm. You may disconnect any account at any time; doing so stops all future publication to it.

4. Your content

You keep all rights to the videos, images and text you submit. You grant us only the limited, non-exclusive, temporary licence needed to store, format and transmit that content to the platforms you selected, for as long as the publication requires.

You warrant that you hold the necessary rights to your content — including music, footage and any appearing person's consent — and that publishing it breaches no law and no third party's rights.

5. What you must not do

We may suspend or close an account that breaches these rules, and will explain why where we lawfully can.

6. Third-party platforms

Instagram, Facebook, TikTok, YouTube and Snapchat are independent services governed by their own terms. Your use of each remains subject to those terms, including the YouTube Terms of Service. We do not control their decisions: a platform may reject, restrict, delay or remove a publication, change its rules, or withdraw our access, and we cannot be held responsible for it.

7. Price, trial and payment

8. Availability

We aim for a reliable service but do not guarantee uninterrupted availability. Maintenance, incidents, or an outage at a destination platform may interrupt publication. We are not liable for a publication that fails or is delayed because of a third-party platform.

9. Liability

To the maximum extent permitted by law, our total liability towards you is limited to the amount you paid for the service over the twelve months preceding the event. We are not liable for indirect damages, loss of audience, loss of revenue, or the suspension of one of your social accounts by its platform.

10. Ending the relationship

You may close your account at any time from the settings. We may close your account with 30 days' notice, or immediately in case of a serious breach of these terms or of the law. On closure your data is handled as described in the Privacy Policy.

11. Changes

We may amend these terms. Any material change is announced by email at least 30 days in advance. Continuing to use the service after that date means you accept the new version.

12. Governing law

These terms are governed by the laws of the State of New Mexico, United States, without prejudice to the mandatory consumer protections of your country of residence.
